Marimba couture may update this privacy policy to reflect changes in the legal and regulatory environment, and to keep you informed of changes in our personal data processing practices.

Marimba couture therefore advises you to ensure that you are always aware of the most recent version of the privacy policy whenever you interact with Marimba by consulting this section or by clicking on the “privacy policy” link in the footer of the home page of the site.

1.3 Role and responsibility of Marimba couture

unless otherwise specified in separate notices relating to certain specific personal data processing operations, the personal data processing operations described in this policy are carried out by Marimba couture, a limited liability company with share capital of €5,000, having its registered office at 10, rue de la mairie 09500 lapenne, registered with the foix trade and companies register under number 977 869 163 (hereinafter referred to as “Marimba”), which publishes the site and is therefore the “data controller” within the meaning of the legislation applicable to the protection of personal data.

2 The essentials of the privacy policy

Marimba collects information about you when you use the site, interact with Marimba or make purchases in the store.

In addition to the information you declare (e.g. account creation, newsletter registration), information is automatically collected or generated by Marimba’s systems (e.g. determination of your Marimba product preferences).

2.3 Recipients and transfers

Your personal data is only accessible to authorized personnel working on our behalf in the Marimba stores and entities with which you are in contact, as well as to our teams in charge of customer relations and sales promotions.

In general, your personal data will be kept by Marimba for as long as you are a customer and until the applicable warranties expire. It will only be kept beyond this point with your consent or to meet our legal obligations.

3 The privacy policy in detail

3.1 Use of your personal data by Marimba

Your personal data is only collected when Marimba has a legal basis to do so.

We process your personal data where necessary:

1/ to respond to your requests, in particular :

To send you information about our offers, news and events (newsletters, invitations and other publications via the channels you have chosen – mail, e-mail, telephone, sms, instant messages);

manage your requests and follow up on your queries and complaints;

to improve the operation of the site by compiling statistics, to customize the display of the site according to your preferences, and for targeted advertising purposes in compliance with our policy on the use of cookies.

2/ To provide you with services, fulfill the orders you place and meet our contractual obligations, in particular :

Allow you to create a personal space “your account” and buy Marimba products online;

Manage your orders, deliveries and warranties;

To manage any other current or future services related to the services and included in the related general conditions of use.

3/ For the pursuit of Marimba’s legitimate interests, in particular :

Manage our relationship with you by maintaining a centralized database of existing and potential customers that allows us to proactively manage our business relationship with you;

Ensure the quality of our services by conducting surveys;

Carry out surveys for research and statistical purposes, after rendering the data anonymous or, in any case, implementing procedures designed to prevent the data from being reattributed to an identified person;

Ensuring the security of online transactions, preventing fraud and payment incidents.

Our aim is to constantly improve your customer experience by providing you with personalized offers and services and customized communications that better match your expectations. This is based on a better understanding of your preferences and interests.

Marimba remains solely responsible for the processing of these analyses.

3.2 Note on processing for the prevention and management of payment incidents

As part of the fight against Internet fraud, information relating to your order, as well as information relating to the terminal used to place the order (in particular the operating system used, the location of the machine, whether or not a proxy is used, etc.) is collected automatically and, subject to your consent, is used to analyze your transactions for the purposes of detecting fraud and preventing non-payment. It may be transmitted to our payment service provider and any third party authorized by law for the sole purpose of verifying your identity, the validity of the order, the method of payment used and the delivery envisaged.

3.3 Categories of data collected by Marimba

Information you provide directly to us.

We collect information directly from you when you use our site and services.

This is notably the case when you create an online account, sign up to receive our news, make a purchase online or in one of our stores.

The categories of personal data we collect directly from you include:

Your identification and contact data (for example, your first and last name, e-mail address, telephone number, date of birth, language preference) necessary to identify you or to contact you when you use one of Marimba’s services;

Transactional information necessary to process your order (e.g. your chosen items, postal address for delivery and billing, telephone number, means of payment, including in particular your bank details for billing purposes, including cardholder, card number and expiry date in the case of payment by card);

Data relating to the follow-up of our commercial relationship (for example, your order number, the history of your purchases, your contacts and requests or your correspondence with our customer service department);

Socio-demographic data (e.g. your age, occupation, etc.) ;

Data relating to your preferences;

The personal data required by Marimba to fulfill the purposes described above are indicated on the various pages of the site. If you do not fill in these mandatory fields, Marimba will not be able to respond to your requests and/or provide you with the requested products and services. Other information is optional and enables us to get to know you better and improve our communications and services to you.

In our boutiques or during events that we organize (for example: fashion shows or private sales in your boutique), we may collect additional personal data under the conditions and for the purposes that are specifically notified to you on this occasion.

The information Marimba collects automatically

Other data is collected automatically when you access the site, use our services or carry out a transaction with us:

Connection data concerning the terminal used: your IP address, browser type and browsing information are also collected for administration and/or statistical purposes, as detailed in the cookie use policy;

Information about your browsing: use of cookies and other tracking technologies to collect information about you, in particular about your preferences and interests;

Geolocation information

Recording of calls to Marimba customer service: your conversations may be recorded to ensure the quality of service.

Information about third parties

In some cases, Marimba collects information that you provide about other people, for example when you decide to buy and send products to someone else. This information is used solely to respond to your requests and not to send marketing communications to your contacts unless they choose to receive communications from Marimba.

3.4 Recipients of your personal data

Site and service management

Your personal data is processed by Marimba. It will not be transferred or made accessible to any third party, subject to the following conditions (i) Marimba’s subcontractors and service providers, such as customer service or those working exclusively for technical and logistical reasons (for example, carriers, site hosting and maintenance service providers, payment and fraud management service providers) and (ii) any restructuring of our company, including total or partial disposal of assets, mergers, acquisitions, spin-offs and more generally any reorganization operation to ensure continuity of services.

Personalized customer management, prospecting

Your personal data is accessible to authorized personnel working on our behalf in the Marimba stores and entities with which you are in contact, as well as to our teams in charge of customer relations and sales promotions.

With your consent, you can receive information on offers, news and events from our company.

Protecting and defending Marimba’s rights

Finally, Marimba may disclose your personal data to third parties if such disclosure is required by law, regulation or court order, or if such disclosure is necessary to protect and defend its rights (e.g. to our agents and external advisors in the event of debt collection; to our insurers in the event of a product loan).

The display of our offers via social networks and third-party services

We may, on the basis of our legitimate interest in promoting our products and services, display offers relating to Marimba products via social networks and services published by the companies meta (social network instagram and facebook), google (youtube services, gmail, google search engine) and tiktok.

To this end, only your e-mail address and/or telephone number will be communicated securely to these companies in order to check whether you are also a user of the social network or service referred to above and to display our offers to you on the corresponding platform. On this basis, we may also use the tools of these companies to display offers to users of the social network or service with a profile similar to our customers and prospects. The performance of these operations implies the transfer by meta, google and tiktok of your e-mail address and/or telephone number to meta, google and tiktok. Such data processing and transfers are governed by the appropriate conditions and safeguards established by meta, google and tiktok respectively, in accordance with their own data protection policies, which we invite you to consult: meta policy for instagram; google policy; tiktok policy.

You may at any time object to the display of our offers on these social networks and third-party services by contacting us as described in section 3.10 or by consulting the advertising configuration options offered by meta for instagram, by google for youtube, gmail and the google search engine, and by tiktok.

3.5 Shelf life

Marimba does not keep your personal data longer than is necessary for the purposes for which it was collected.

Newsletter, contacts and complaints

The identification data concerning you used, with your agreement, for the purposes of sending newsletters and other Marimba publications will be kept for a period of three years from the date of collection or last contact with you.

Personal data about you and general information about your requests (e.g. date of opening, closing, subject of request and your information) collected and processed in the context of the contact section or contacts with customer service are kept for 5 years in our unique customer repository. Telephone recordings are kept by our customer service department for 6 months.

Marimba may also retain for archival purposes copies of communications with users of the site and any responses to questions or comments sent to users by our customer service department.

– Data relating to orders, purchasing history and customer knowledge

Data relating to your orders will be kept by Marimba as long as you are a customer (you have an active customer account or are a regular contact of our stores) and until the expiry of the applicable guarantees. It will only be kept beyond this point with your consent, or for accounting and evidentiary purposes, or to meet our legal obligations.

– Banking data

Your bank details will be kept securely for the time required to validate your order and make payment, and will then be immediately destroyed. In the event of a payment incident, your data will be kept for the duration of the incident, then for a period of three (3) to five (5) years depending on the seriousness of the incident.

– Customer account data

Your customer account on the site will remain active as long as you have not decided to close it and as long as you make purchases on our site. In the event of prolonged inactivity on your part for a period of 3 years, this account will be deactivated.

At the end of this three-year period, Marimba may contact the customer concerned again to find out whether he or she wishes to (i) continue to receive newsletters and other publications from Marimba and/or (ii) maintain a customer account on the site. Your data will also be destroyed within a maximum of 30 working days of your request to unsubscribe.

In all cases, customers have the option of closing their account and/or unsubscribing from newsletters at any time. To do so, you can contact our customer service department by e-mail at contact@marimbacouture.com. To exercise this right, please fill in the “contact” form on our site, specifying your request.

Finally, connection logs collected, subject to your consent, within the framework of cookies and other tracers implemented on our site, will be kept in accordance with applicable regulations for a period not exceeding thirteen (13) months. For more details, see our cookie use policy.

3.6 Links

The site may contain links to third-party websites. Marimba has no control over the content, privacy policy or actions of these third-party websites. The use of information that you may provide to third parties on other sites or that such third parties may collect on other websites is not governed by this Privacy Policy. You should carefully review the privacy and data protection policies of third-party websites and contact the publishers of these sites if you have any questions about how they use information about you. Marimba cannot be held responsible for any third party who does not use your personal information in accordance with that third party’s privacy policy or in accordance with any contractual or legal obligation to which that third party is subject.

3.7 Safety

Marimba has implemented appropriate technical and organizational measures to ensure the confidentiality and security of your personal data against loss, destruction, alteration, unauthorized access or disclosure. In particular :

Marimba’s computer systems are protected by state-of-the-art hardware and software. Procedures for the physical and electronic safeguarding of data collected on the site have been implemented, in accordance with current French legislation and European regulations on the protection of personal data.

Marimba employees who, by virtue of their position, have access to your personal data are subject to confidentiality obligations.

Marimba’s service providers and subcontractors are bound by written commitments to implement sufficient security measures to ensure the protection of your personal data in compliance with applicable legislation.

All the financial information you provide on the site is stored in the secure site of the financial institution chosen by Marimba. Transactions on the site are protected by ssl encryption.

3.8 Changes and updates to the privacy policy

This privacy policy reflects Marimba’s professional practices. It may be amended and updated to reflect changes in Marimba’s practices, to make them more precise or to ensure compliance with regulations.

In the event of a change or update, the revised privacy policy will be posted on the site, along with the last update date.

3.9 Your rights and options

Access and rectification

You have the right to access your personal data, as well as the right to request the rectification or deletion of any data found to be inaccurate. If you have a Marimba customer account, you can directly access the data contained in your online account and rectify/delete them if necessary, as well as the history of your transactions and your choices regarding commercial prospecting.

Where applicable, you must ensure that you provide Marimba with any updates or changes to the information concerning you, including in particular those relating to your postal and/or e-mail address, in order to enable us to send your orders to the correct address and to contact you regarding the latter if necessary.

Other rights :

Deletion. You may also request the deletion of your personal data if Marimba no longer needs to keep it.

Opposition. You may also object to the processing of your personal data or request that it be restricted, except where processing is necessary for the management of the services you have subscribed to.

Withdrawal of consent. Where the processing of your data is based on your consent, you may withdraw this consent at any time.

Portability. You may also exercise your right to portability (i.e. to obtain it in a structured, computer-readable form) in respect of personal data that you have provided to us directly on the basis of consent or of a contract concluded with you and which is subject to automated processing.

Guidelines. You can also inform us of your instructions concerning the conservation, deletion and communication of your personal data after your death and modify these instructions at any time.

These rights may be exercised directly with Marimba. Proof of identity may be required.
